TERMS AND CONDITIONS

GENERAL GYM POLICIES

All personal training clients must complete the following forms: Lifestyle and Health History, Physical Activity Readiness Questionnaire (PAR-Q), Liability Waiver, Informed Consent, Personal Training Contract/Terms and Conditions, and any subsequently required documentation to participate in personal training services. Clients are responsible for disclosing all relevant health and medical conditions to the trainer before the first scheduled training session, including but not limited to injuries, allergies, medications, or other medical information that may be relevant when participating in personal training sessions. If clients withhold medical information from the trainer, the trainer will not be held liable for any symptoms or injuries sustained.

PERSONAL TRAINING RESCHEDULES & CANCELLATIONS

All Personal Training sessions must be canceled and rescheduled with a minimum of 24 hours' notice. Failure to provide 24 hours' notice will result in the forfeiture of a prepaid session. A prepaid session will be deducted automatically from your purchased sessions for failure to provide ample notice of a cancellation or reschedule. If you don’t attend a personal training appointment, this is considered a late cancellation and will result in the forfeiture of a prepaid session. Please communicate this to your trainer if you plan to be late to a session, as all sessions after 10 minutes past the hour will be canceled and forfeited if there has been no communication of your planned arrival. Sessions are 50 minutes long, and your session will be canceled and forfeited if we have less than 30 minutes remaining in your session upon your arrival. Cara Conway Personal Training will allow complimentary same-day rescheduling or cancellations of appointments only in the event of: Emergency Situations, COVID, Inclement Weather, Gym Closure, and Trainer Absence. Any same-day cancellation outside of these reasons will result in the forfeiture of a prepaid session. If you are sick, please let your trainer know as soon as possible, as calling out for repeated sick days without advanced notice will result in the forfeiture of prepaid sessions. Cara Conway Personal Training will provide you with a complimentary session if your trainer needs to cancel or reschedule without providing you with at least 24 hours notice for any reason other than an emergency, sudden illness, or gym closure. Your trainer will be prepared for your session, and we expect the same from you. Let’s stay accountable to ourselves and each other, so we both succeed.

PERSONAL TRAINING CONTRACTS & PAYMENTS

Payment in full or the initial payment on your subscription plan is required before scheduling personal training sessions. We offer private one-on-one personal training and semi-private training sessions. Semi-private sessions are limited to two clients and one trainer. All personal training sessions are 50 minutes long and start at the top of the hour. We ask that you show up to your sessions on time and depart at the end of your 50-minute session. The 10 minutes at the bottom of the hour are reserved for the trainer to take applicable notes of your session, clean/organize the gym and prepare for the next client. Sessions are private, so we ask you to wait to enter the gym until your session starts. Personal training sessions are purchased in packages of 3-month contracts, or our trial contract, which includes four sessions. Please refer to our website for up-to-date pricing for all our contract offerings. 3-month contracts may consist of 1, 2, or 3 sessions per week, depending on your training needs. Personal training contracts may include 12, 24, or 36 sessions. To cancel a personal training contract, Cara Conway Personal Training must receive a request for cancellation within seven days of the first scheduled training session. All remaining/unused personal training sessions will be refunded when requested within seven days of your first scheduled session. After seven days have passed from your first scheduled training session, cancellations and refunds will not be issued for any reason, including but not limited to relocation, illness, and unused sessions. Credit is non-transferable. Clients are welcome to pay in full for their training contract or choose to sign up for our subscription plan. 3-month personal training contracts require 50% of the purchase price due at signing and the remaining balance will be split equally over the following two months, automatically charged to your card on file. Subscription plans effectively start after your first payment, and your card on file will automatically be charged each successive month until your contract has been paid in full. Subscriptions automatically end with your last payment. To continue training, a new personal training contract must be purchased. All trial 4-pack personal training contracts must be paid in full at signing. Cara Conway Personal Training offers trial contracts of 4 sessions total. Trial contracts (4-packs) are NON-REFUNDABLE and expire within 30 days of your first personal training session. All personal training sessions for 3-month contracts must be used within 120 days. All private and semi-private personal training sessions not used after these periods are void.

COMPLIMENTARY PERSONAL TRAINING 30-MINUTE CONSULTATIONS

Cara Conway Personal Training offers complimentary 30-minute personal training consultations with our NASM Certified Personal Trainer, Cara Conway. Before your free consultation can be scheduled, clients must complete our Lifestyle and Health History Form and PAR-Q via our website. Please refer to our website for information about what to expect during the consultation. If you need to cancel or reschedule, we ask that you provide at least 24 hours’ notice.

PHOTO/VIDEO POLICY

Cara Conway Personal Training will not take or use pictures/videos without prior written consent from the client. Clients should feel comfortable knowing their private sessions are private. If Cara Conway Personal Training wants to take photos or videos for public use, we will ask and obtain client permission prior. Clients who permit Cara Conway Personal Training to take and use photos/videos for public use will sign our photo release form. If the client asks the trainer to take a photo or video of them during their session, the trainer and Cara Conway Personal Training are released from all liability.

SECURITY

The premises in which Cara Conway Personal Training operates is under 24-hour video surveillance to protect both the client/s and trainer. Recordings are automatically uploaded to the cloud and will only be accessed with a valid reason. Recordings will not be used publicly for any reason other than to protect the client, the trainer, and the gym.

LOST PROPERTY

All lost property at Cara Conway Personal Training is kept at the gym for 30 days. After 30 days, all lost items will be removed from the gym and donated or tossed. Any confirmed/identified lost client items will be set aside/held for 30 days, requiring in-person client pickup. If you know you have lost something at our gym, you must contact Cara Conway via text or email.
